These terms and conditions cover any transactions or orders placed with Uncommon Ancestor Limited (‘Uncommon Ancestor’ or ‘we’) whether online, via email, in person or any other form. By placing your order with Uncommon Ancestor, you agree that these Terms are binding without exception, and you acknowledge to have read and understood them. If you do not agree to any of the Terms, you should not progress with an order.

PRODUCTS

We have taken every step to accurately describe and photograph all our products. However, slight variations can occur through the publishing process (print or online) and we cannot guarantee that your computer monitor’s display of all images and colours will be true to life. If you are unsure and need further clarification or additional images, please contact us at kara@uncommonancestor.com.

Neither can we guarantee that the quality of any of our products or other materials purchased by you will meet your expectations, but we do all we can to ensure our offering is of the highest standards and our online representation is as accurate as possible.

All measurements stated are approximate and variations can occur, especially relating to bespoke furniture pieces, which can have up to 20% tolerance on dimensions. Please accommodate this when measuring up and/or devising room layouts.

Uncommon Ancestor reserves the right but is not obligated, to limit the sales of our products to any person, geographic region, or jurisdiction. We reserve the right to limit the quantities of any products we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.

HANDMADE

Every product that is specified as handmade or bespoke is unique, and no two pieces are the same. When ordering or purchasing a handmade product, you accept that there will be a variation from the image advertised. If you are considering one of our handmade pieces but are concerned or unsure about the possible differences in materials or dimensions (which can vary up to 20%), we will be happy to talk you through the production process to assist you in making a final decision.

Such variations are inherent in the manufacturing of handmade products, so you may expect minor distinctions that will make your product purchase truly one of a kind. Some slight imperfections and subtle differences should not be the basis of rejects or returns. Variations in the finished product may slightly vary from photograph to final product.

All Uncommon Ancestor are designed by us and locally handcrafted by artisans and small businesses. We believe in supporting local artisans and other creative businesses in producing feature furniture pieces. With handcrafted products, the artist's individuality is imprinted on the design and although we maintain regulated design processes, each piece will have a slight variation and difference.

ORDERS

All quotes are valid for 30 days. Prices are subject to change at any time after the 30 days. When placing an order, please ensure all information provided including shipping details is correct. Orders can only be processed for production when the client has confirmed all details (design style, dimensions, materials, finishes, etc.) in writing. If you would like to discuss a custom design, please contact us at kara@uncommonancestor.com. Once we have received your email, the team will get back to you as soon as possible.

PAYMENT

All items from the Bespoke collection are made to order and production will commence on receipt of the total amount. We accept payment via credit card, debit card and bank transfers. Duties, taxes, and any fees related to the import of an order are not included in quotes or invoices and are due upon receipt of goods to the local government. We will include full payment details on the final invoice.

PRODUCTION

Production times vary from 8-16 weeks, depending on fabric choice and stock availability. Production lead times are provided for guidance and every effort is made to ensure these are as accurate as possible. Uncommon Ancestor will try its best to ensure that the order is completed within the estimated lead time. However, lead times are subject to fluctuation and are dependent on various external factors. If some pieces take slightly longer than quoted due to reasons outside our control, we will notify the purchaser as soon as possible. Uncommon Ancestor cannot be held responsible for production delays or any knock-on effects these may cause. We ensure all fabric supplied is treated to meet appropriate British FR standards. If treatment is not possible, inter interliner will be used.

WARRANTY

Uncommon Ancestor offers a six-month warranty period to repair or replace any defective goods.

USE OF GOODS

While its products are well made and designed to the best of its ability, Uncommon Ancestor products are NOT specifically tested for ‘commercial’ or public use environments. Uncommon Ancestor does not warrant the suitability of products for use in commercial and/or public use environments, and commercial, and non-personal purposes.

Given that Uncommon Ancestor cannot control the environment in which the product(s) is intended to be used by the Client and other persons, it cannot be held responsible for any damage or injury to people or otherwise whatsoever. As with all environments (namely domestic use but also specifically in commercial, public use spaces), Uncommon Ancestor is unable to prevent or guard against the misuse of its products, such as continued ‘rocking’ on or dropping of chairs, rough handling, and/or standing on chairs, tables, shelves or other furniture items not explicitly designed for such a purpose.

In consideration of the above, the Client is responsible for ongoing checks of the product(s) to identify signs of damage, failure or loose joints on chairs, and to remove the said product(s) from use immediately if any sign of a crack or loose joint is evident therein.

The Client agrees that it shall ensure that any persons handling the Goods including but not limited to cleaning staff, refrain from rough handling of furniture which can often damage or scuff the Goods.

Regarding the materials from which the Goods are made, Uncommon Ancestor uses wood in many of its products, which is a very durable and robust material. However, we advise that because timber is a natural product it can contain latent defects such as hairline cracks that only become apparent with time which Uncommon Ancestor could not have reasonably identified at the time of production or completion of the order. Uncommon Ancestor warrants that to the best of its knowledge, there are no structural defects in the timber used at the time of producing the Goods, it cannot reasonably foresee. It, therefore, cannot be held responsible for future defects.

Uncommon Ancestor advises that certain climatic conditions, such as air- conditioning & heating, and/or extreme temperatures can cause timber to crack and cause damage that is out of Uncommon Ancestor’s control. For most materials and finishes, they will over time display naturally occurring imperfections, for which Uncommon Ancestor cannot be held liable.

If the Client subsequently sells or gives the Goods purchased in terms of this Agreement to a third party, the Client acknowledges that it is the Client’s responsibility to advise such third party of the use and care terms relating to the Goods.

COPYRIGHT

All of the content seen on this website, including, for example, all of the page headers, images, illustrations, graphics, audio clips, video clips, and text, are subject to trademark, service mark, trade dress, copyright and/or other intellectual property rights or licenses held by Uncommon Ancestor Limited.

Uncommon Ancestor grants the user permission to view electronically, copy and print in hard copy portions of the site for the sole purpose of browsing the site for the user’s personal use only. Any other use of materials on the site, including reproduction for purposes other than those noted above, modification, distribution or reproduction, without the prior written consent of Uncommon Ancestor Limited and the lawful trademark and/or copyright owner (if applicable) is strictly prohibited and constitutes an unlawful infringement of the intellectual property rights of Sister and/or such trademark and/or copyright owner.

INTELLECTUAL PROPERTY

The Client acknowledges that copyright, design, trademarks and all intellectual property rights in the Goods (whether custom made to order by the Client or not) and the business name and trading style of Uncommon Ancestor Limited vests solely in Uncommon Ancestor and that no rights of any kind in the Uncommon Ancestor IP including but not limited, the right of licence, are granted to the Client or to any other party. The Client further undertakes to Uncommon Ancestor that it/she/he will in no way, whether directly or indirectly in any capacity replicate, reproduce, or misuse any of the Uncommon Ancestor IP, or cause or permit any other person to do any of the foregoing. We may own intellectual property rights in our goods and you may not use those rights without our permission. We may prosecute you for any violations of our proprietary rights.

LAW

The entire provisions of these Terms shall be governed by the courts of England and Wales.
